很多(duo)制造型(xing)企(qi)業,因為市(shi)場(chang)需求(qiu),用工(gong)需求(qiu)一(yi)直都在變化,為了(le)有效地(di)控制人工(gong)成本(ben),降低招聘的壓力,不(bu)少企(qi)業都開始(shi)聘用非全日制員(yuan)工(gong)。
那么(me)企業使用非(fei)全日制員工,需要注意些(xie)什么(me)呢?
根據《勞(lao)動合同(tong)法(fa)》第六(liu)十八(ba)條規定,所(suo)謂的非全日(ri)制用(yong)(yong)工(gong)是(shi)指(zhi)以小(xiao)時計(ji)酬(chou)為主,勞(lao)動者在(zai)同(tong)一(yi)用(yong)(yong)人(ren)單位一(yi)般平均(jun)每日(ri)工(gong)作時間不超過四(si)小(xiao)時,每周工(gong)作時間累計(ji)不超過二(er)十四(si)小(xiao)時的用(yong)(yong)工(gong)形式。
常(chang)見的(de)非全日(ri)制用工包(bao)括實習、兼職和退休返聘。
1、非全(quan)日制(zhi)用工(gong)可以不簽(qian)訂(ding)勞(lao)動合同,用人(ren)單位可以口頭(tou)約(yue)定勞(lao)動報酬(chou)等(deng)事項,也(ye)不存(cun)在雙(shuang)倍工(gong)資的問題;
2、非全日制用(yong)(yong)(yong)工可以(yi)(yi)隨時終止用(yong)(yong)(yong)工,不需要支付經濟補(bu)償金,不存在勞動關系,企業可以(yi)(yi)根據業務需要,靈活調整用(yong)(yong)(yong)工人數(shu);
3、非全日(ri)制(zhi)(zhi)用(yong)(yong)工不(bu)需(xu)要(yao)繳納社會保(bao)(bao)(bao)險費,用(yong)(yong)人單位不(bu)需(xu)要(yao)為(wei)非全日(ri)制(zhi)(zhi)用(yong)(yong)工的勞動者參加基(ji)本(ben)(ben)養老保(bao)(bao)(bao)險、基(ji)本(ben)(ben)醫療保(bao)(bao)(bao)險、生育(yu)保(bao)(bao)(bao)險和失(shi)業保(bao)(bao)(bao)險,只需(xu)要(yao)為(wei)員(yuan)工參加工傷保(bao)(bao)(bao)險。
按照《勞動合(he)同法》第六十八條規定(ding),工(gong)資分配所采取的最基本的兩種方式是(shi)計(ji)(ji)時(shi)工(gong)資和計(ji)(ji)件工(gong)資。按照《勞動保障部(bu)關于非全日(ri)制(zhi)用工(gong)若干(gan)問題的意見》規定(ding),非全日(ri)制(zhi)用工(gong)小(xiao)時(shi)計(ji)(ji)酬標準不得低于用人(ren)單位所在地人(ren)民政府規定(ding)的最低小(xiao)時(shi)工(gong)資標準。
支付周(zhou)(zhou)期最長不得(de)超(chao)過十(shi)五日,根據《勞動(dong)合同法》第七十(shi)二條第二款,非全(quan)日制用工勞動(dong)報(bao)酬結算支付周(zhou)(zhou)期最長不得(de)超(chao)過十(shi)五日。
所(suo)以企業對于非(fei)全日制(zhi)用(yong)工的薪(xin)資支付一定要及時,而(er)且標準也不是想定多少(shao)就(jiu)定多少(shao)。
根據相關法律規定,用人單位支(zhi)付的小時(shi)工(gong)(gong)(gong)資中(zhong)并未涵蓋工(gong)(gong)(gong)傷保險(xian)(xian)(xian)(xian)費用,因此單位應當及時(shi)為建立勞動(dong)關系的非(fei)全日(ri)制(zhi)勞動(dong)者繳(jiao)納工(gong)(gong)(gong)傷保險(xian)(xian)(xian)(xian)費,以避免相關風險(xian)(xian)(xian)(xian)與(yu)責任。所以企(qi)業在使用非(fei)全日(ri)制(zhi)員工(gong)(gong)(gong)時(shi),就應該及時(shi)為員工(gong)(gong)(gong)購買工(gong)(gong)(gong)傷保險(xian)(xian)(xian)(xian),一旦從事非(fei)全日(ri)制(zhi)工(gong)(gong)(gong)作的勞動(dong)者發生(sheng)工(gong)(gong)(gong)傷,依法享(xiang)受工(gong)(gong)(gong)傷保險(xian)(xian)(xian)(xian)待遇。
應當參(can)(can)加工傷(shang)(shang)保(bao)(bao)險(xian)(xian)而未(wei)(wei)參(can)(can)加或(huo)者未(wei)(wei)按(an)(an)規定繳(jiao)納(na)工傷(shang)(shang)保(bao)(bao)險(xian)(xian)費(fei)(fei)的(de)用(yong)(yong)人單(dan)(dan)(dan)位(wei),未(wei)(wei)參(can)(can)加工傷(shang)(shang)保(bao)(bao)險(xian)(xian)或(huo)者未(wei)(wei)按(an)(an)規定繳(jiao)納(na)工傷(shang)(shang)保(bao)(bao)險(xian)(xian)費(fei)(fei)期(qi)間,從(cong)業人員發生(sheng)工傷(shang)(shang)的(de),由(you)用(yong)(yong)人單(dan)(dan)(dan)位(wei)按(an)(an)照(zhao)規定的(de)工傷(shang)(shang)保(bao)(bao)險(xian)(xian)待(dai)遇項目(mu)和標準支付費(fei)(fei)用(yong)(yong)。如(ru)用(yong)(yong)人單(dan)(dan)(dan)位(wei)參(can)(can)加工傷(shang)(shang)保(bao)(bao)險(xian)(xian)并補繳(jiao)應當繳(jiao)納(na)的(de)工傷(shang)(shang)保(bao)(bao)險(xian)(xian)費(fei)(fei)、滯納(na)金后,由(you)工傷(shang)(shang)保(bao)(bao)險(xian)(xian)基(ji)金和用(yong)(yong)人單(dan)(dan)(dan)位(wei)依(yi)照(zhao)規定支付新發生(sheng)的(de)費(fei)(fei)用(yong)(yong)。
因當地政策致使單位無法為非全日制員(yuan)工單獨繳納(na)工傷(shang)保險費的(de),企業可(ke)考(kao)慮購買雇主責(ze)任險等商業險種以分(fen)擔用(yong)人風險。
非全日(ri)制用工(gong)的(de)工(gong)作時間一般(ban)為每天四小時,每周工(gong)作時間不(bu)超(chao)過(guo)二十(shi)四小時,這與全日(ri)制用工(gong)實行每天工(gong)作不(bu)超(chao)過(guo)八小時,每周不(bu)超(chao)過(guo)四十(shi)小時的(de)工(gong)時制度是不(bu)同(tong)的(de),因此,非全日(ri)制用工(gong)的(de)工(gong)作時間必須符合(he)法定(ding)的(de)要求,用人單位對(dui)此要承擔舉證責任,否則有被認定(ding)為全日(ri)制用工(gong)的(de)風(feng)險(xian)。
非全日制用工雖然優勢很明顯(xian),在未來(lai)也將被更多企業采(cai)用,但(dan)涉及到(dao)的用工風(feng)險還是(shi)要及時防(fang)范,切勿因小失(shi)大。
